Understanding False Arrest

A false arrest is the unlawful restraint of a person's freedom of movement. It occurs when someone takes another person into custody without that person's consent or legal justification, or holds another person against their will. While anyone can be liable for false arrest, one of the most common settings is the retail store and the accusation of shoplifting.

When Retailers Get It Wrong

At Beauchamp & Idlett, we have seen large retail companies over-zealously accuse customers of shoplifting. Store employees routinely allege that a customer has stolen merchandise without adequate proof. With a single call to 911, the customer is arrested and booked into jail based solely on an employee's assumption.
